Metafy Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between Metafy (Pty) Ltd ("the Company", "we", "us") and the user ("you"). By accessing www.metafy.co.za or purchasing any product, you unconditionally agree to these Terms.
1. Right to Refuse Service and Order Cancellation
Metafy reserves the sole right to refuse service, terminate accounts, or cancel orders at our absolute discretion without prior notice. This includes, but is not limited to, orders where we suspect technical errors in pricing, fraudulent activity, or potential resale.
2. Pricing and Availability Errors
While we strive for accuracy, Metafy does not warrant that product descriptions or prices are error-free. In the event of a "glitch" or "obvious error" in pricing, Metafy is not obligated to honor the incorrect price and reserves the right to cancel the order and provide a full refund as the sole remedy.
3. Limitation of Liability (The "Wearable" Clause)
To the maximum extent permitted by South African law, Metafy shall not be liable for:
- Physical Injury: Any injury or health issues resulting from the use of wearable technology.
- Privacy Violations: Any legal action taken against you for recording or photographing individuals without consent using devices purchased from us.
- Software Malfunctions: Any bugs, AI "hallucinations," or data loss resulting from Meta’s software or firmware.
- Financial Loss: We are not liable for any indirect, incidental, or consequential damages arising from your use of the site or products.
4. Limited Warranty and Returns
- "Change of Mind": Per the ECTA, returns are only accepted within 7 days if the item is completely sealed. Once the manufacturer’s seal is broken, the item is considered used and is ineligible for a "change of mind" return due to the nature of personal wearables.
- Defects: Warranty claims are subject to the manufacturer’s (Meta/Luxottica) assessment. Metafy reserves the right to attempt a repair before offering a replacement or refund.
- Exclusions: Damage caused by "jailbreaking," unofficial software updates, or physical neglect (scratched lenses, water damage) voids all warranties.
5. Intellectual Property and Brand Rights
All trademarks, logos, and content on www.metafy.co.za are the exclusive property of Metafy. You may not use our branding, product photography, or meta-data without express written consent.
6. User Indemnification
You agree to indemnify, defend, and hold harmless Metafy (Pty) Ltd and its directors from any claims, damages, or legal expenses (including attorney fees) arising from your breach of these Terms or your misuse of the products purchased from our store.
7. Product Use and Compliance
By purchasing AI/Camera-enabled glasses, you acknowledge that you are solely responsible for complying with South African privacy laws (including POPIA). Metafy is a retailer only and bears no responsibility for the user's data-gathering habits or privacy infringements.
8. Delivery Risks
The risk of loss and title for all items passes to you upon our delivery to the courier. While we assist in tracking, Metafy is not responsible for delays caused by third-party courier companies or labor strikes.
9. Modifications to Terms
Metafy reserves the right to update or change these Terms at any time without notice. Your continued use of the website following any changes constitutes acceptance of those changes.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. You agree that any legal action against Metafy must be brought in the courts of South Africa.
